Carpi Competitions is a promoter of prize draws which results in the allocation of prizes in accordance with the terms and conditions on the website https://carpicompetitions.com/.

The promoter may run multiple competitions at one time, each competition will have a predetermined prize.

Your Carpi Competitions Account

In order to enter a Competition, you will need to register an online account with us.

(a) To register an account you will be asked to provide an email address or sign in via a social media account, such as Facebook, Apple, or Google (‘Social Media Account’).

(b) Please note that your email address or Social Media Account will also be the username that you use to log in to your account. Each account can only have one username attributed to it at any given time (“Carpi Competitions Account”). Therefore, you cannot attribute multiple email addresses, or Social Media Accounts to your Carpi Competitions Account. For example:

   (i) You cannot have an email address and a Social Media Account attributed to your Carpi Competitions Account.

  (ii) You cannot have two or more email addresses attributed to your Carpi Competitions Account.

  (iii) You can, however, change your username for your Carpi Competitions Account by logging into your  Account.

1.  The Promoter

1.1 By entering the competition, entrants are deemed to have read and agreed to these terms and conditions and are legally bound by them.

1.2 All entrants must submit all the contact details requested by the promoter which includes email address, contact number and full name, to be used for the purpose of notifying the winner, to be able to post the winners name on the winner’s section of the promoters website and social media platforms and to comply with the privacy policy.

1.3 It is the entrant’s responsibility to provide the promoter with correct and up to date contact information.

1.4 The promoter accepts no responsibility for failure or inability to make contact with any entrant due to errors in the providing of inaccurate information from the entrant. 

1.5 By entering the competition the entrant (‘entrant’, ‘you’, your(s)’) will be deemed to have legal capacity to do so. You will have read and fully understand the terms and conditions and are bound by them and any other relevant requirements set out in any promotional material.

2. Privacy policy 

2.1 The Entrants and the promoter recognise that the promoter may use contact details and other data including personal data as defined by the Data Protection Act 1998 supplied by the Entrants to the Promoter to administer the Website and conduct the Competition according to these Terms and Conditions.

2.2 The Entrants and the promoter also recognise that the promoter may (either by choice or at the request of a third party) also disclose this information to relevant third parties for the purposes of the prevention of fraud, money laundering, legal or other financial or regulatory reasons.

3. Competition

3.1 The Competition is operated by Carpi Competitions.

3.2 The Competition is open for entry to all persons aged 18 or over excluding the owners, their family (1st grade), professional advisers or anyone else connected with the development or operation of the Website or conducts administration of the Competition in any way, shape or form.

3.3 By entering into the Competition, all Entrants acknowledge that their payment for each entry to answer the Question (when there are any) and thereby enter the Competition does not guarantee in any way that they will win the prize.

3.4 Only completed Entries which contain the correct answer as held by the Promoter will be entered into the Competition. Failure to answer any question (when there are any) correctly via the website will still result in any entrant still being charged.

3.5 As a condition of entering the Competition, Entrants must ensure that, by doing so, they do not contravene any laws of their country of residence. The Promoter will not be liable in any way if an Entrant enters the Competition unlawfully.

3.6 The Entrants and the promoter recognise that the Competition, its administration and all associated activities are governed by English Law and the promoter and Entrants recognise that the County or High Courts of England shall have exclusive jurisdiction in the event of any dispute arising out of the Competition or its administration.

3.7 The promoter reserves the right to refuse or disqualify any entrant if it has reasonable grounds for believing that an entrant has contravened any of these terms and conditions or acted in a way that is reasonably considered by the Promoter to be illegal.

3.8 All Entries will become the property of the promoter on receipt and will not be returned.

3.9 Availability and pricing of competitions is at the discretion of the promoter and will be specified at the point of sale on the website.

4. ENTRY

Some competitions will have a predefined question to be answered in order to qualify you to enter the competition. The question (when there are any) being answered proves the element of skill or knowledge required in order to be eligible for the opportunity to win the prize.

4.1 In answering the Question (when there are any), the Entrant recognises that they must exercise skill, knowledge and judgement to give the correct answers. Company reserves the right to update, amend, or change a question to a Competition where it may be required. In those instances, all correct answers already given to the previous question prior to it being updated will still be valid for Entry into the Competition draw.

4.2 There is no limit to the amount of times a person can enter a competition. Unless the competition specifies a capped number of entries per person. Creating multiple accounts to enter prizes with capped ticket amounts will be seen as a breach of fair use and could potentially void entry. Refunds will not be given to those who create multiple accounts to exceed maximum entries.

4.3 In order to Enter a Competition, Entrant must first create an account on the Carpi Competitions website and input their full details, including: name, year of birth, email address, phone number, and address. By Entering a Competition, each Entrant confirms they are eligible to do so in line with these terms and conditions and are eligible to claim any Prize that they may win. Eligible Entrants may then Enter their chosen Competition by following the instructions displayed on the Competition page. Once you have selected your answer to the question you can then complete your online order and you will receive an email confirming your payment has been successful. Confirmation of your order will also be shown and available to view within the account area when securely logged into your account on the website. Confirmation of payment and the issuance of ticket numbers does not guarantee Entrant an Entry to the Competition draw.

4.4 Payment will be made in pounds sterling (GBP) by the entrant via the payment gateway on the website.

4.5 All Entries to the Competition are final and no refunds shall be made at any time or for any reason, except in the case of entries submitted after the Closing Date or if the competition gets cancelled.

4.6 You may enter a Competition (whether a Standard Competition or a Instant Win Competition) for free postal entry by complying with the following conditions:

   (a). send your entry by pre-paid first or second class post to the Promoter at the following address: VW HOUSE, SELINAS LANE, DAGENHAM, LONDON, RM81QH

   (b). hand delivered entries will not be accepted and will not be entered into the random draw;

   (c). include with your entry the following information:

   ▪ details of the Competition you wish to enter;

   ▪ your full name;

   ▪ your date of birth;

   ▪ your postal address;

   ▪ a contact telephone number and email address; and

   ▪ your answer to any Competition Question.

   (d). Bulk entries received will be treated as one single entry. Any postal entry failing to meet the requirements will not be entered into the relevant competition.

4.7 The promoters decision is final and no correspondence will be entered into about the result of the Competition following the determination of the Winner as described above.

4.8 Each Entrant agrees that the usual requirement under the Consumer Protection (Distance Selling) Regulations 2000 for any goods and services ordered online to be supplied within 30 days will not apply to this Prize Competition.

5. CLOSURE OF THE COMPETITION

5.1 The Promoter reserves the right at its sole discretion to extend the closing date of any competition, if for any reason any aspect of the competition is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Competition. The Promoter may in its sole discretion cancel, terminate, modify or suspend a Competition, or invalidate any affected entries. In the event that the Promoter closes a Competition early, the Winner may be selected from all valid and eligible Entries received by the Promoter prior to the date of closure, except that the Promoter reserves the right, at its sole discretion, to close a Competition early without selecting a Winner. In the event that a Competition is closed without selecting a Winner, the Promoter will give all entrants Carpi Competitions to enable them to replay equivalent tickets in a subsequent competition.

5.2 When the Maximum Number Of Entries and/or the Closing Date is reached, the Competition will close; however the date may be brought forward if the entries are sold sooner than the closing date. Competitions could be extended beyond the date specified if the target number of tickets is not achived at least 80%.

5.3 If the Winner cannot be contacted by the Promoter within 7 days of being notified of their status as the Winner by e-mail, telephone or mail via the contact details submitted along with their entry, then the Promoter reserves the right to then select an Alternate winner, who will then have 7 days to accept the prize following the same routes of contact as the original Winner. The original winner will have no claim to the prize after the Alternate Winner is selected.

6. WINNER

6.1 The winning Entrant will be selected via a live draw on Facebook, each entry  will be assigned a number which appears in their active ticket section. Each draw type may vary, generally a random number generator will be used, however entrants will be notified of how the draw will be done. All draws will be made live within 48 hours of the competition closure. Carpi Competitions guarantees that all winners will be picked at random via the chosen draw method.

6.2 Full details of the draw date/time will be confirmed once the competition has been concluded via social media platforms and on our website. This decision will be made within 48 hours of the close of the competition.

6.3 All Standard Competition Entrants will have their names and entry numbers included on a spreadsheet which may be published on the Website and may be visible during the live draw. If you do not wish to have your name included on this spreadsheet you must contact the Promoter via email at contact@carpicompetitions.com as soon as reasonably possible after you have completed your entry and in any event, at least 48 hours before the live draw takes place.

6.4 For Instant Win Competitions, prizes are allocated at random to numbers in a spreadsheet. Each entry into the Instant Win Competition which correctly answers the Competition Question is then randomly allocated a number in that spreadsheet. If the number matches a prize, then the Entrant wins that prize.

6.5 There will be only one winner per competition unless otherwise stated.

6.6 The Winners will be required to send a copy of their passport to the Promoter to confirm their identity, age and also to prove that if the purchase was made by credit card that the card was legally theirs or that they had authorisation to use it, before any prize will be paid or delivered. Any failure to meet these obligations may result in the Winner being disqualified and the Promoter choosing an alternate winner.

6.7 All Winners will also be required to provide photographs and/or pose for photographs and videos, which may be used in future marketing and public relations by the Promoter in connection with the Competition and in identifying them as a winner of a Competition.

6.8 Following receipt and verification of the details requested above by the Promoter, the Winners will be contacted in order to make arrangements for delivery of the prize. At this point the Winners must choose between the prizes available (as detailed in the Competition prize information on the Website) and notify the Promoter of their choice in writing.

6.9 Surprise Contact Details: On your account page you have the option to add the contact details of an individual who we can contact to help arrange with the surprise if you are a Winner. We will categorically not share or pass these details on to any third party but in adding them you are confirming that you have the consent from the person to pass these details to Carpi Competitions.

7. PRIZE

7.1 The Promoter owns any prize offered from the time the competition is live until successful handover is completed as outlined in section 6.3.

7.2 The Promoter makes no representations and gives no warranties about the Prize, its value, its condition or any other information provided on the Website. The Promoter makes no representations and gives no warranties that the information provide on the Website is accurate, complete or up to date. The Promoter does not imply or give any warranty or accept any valuation to the prize. The Entrant must make up their own decision through their own enquiries and legal advice before entering the competition.

7.3 The prize will only be that as awarded at the time of the draw, no alternatives will be offered under any circumstance.

7.4 Collection of the prize is the sole responsibility of the winner, from the Promoter’s address unless otherwise agreed between the Promoter and the Winner.

7.5 The winner will be required to provide proof of identity and proof of entry into the competition at the time that the prize is collected.

7.6 The prize for the competition is described on the Website (the “Prize”). Details of the Prize are, to the best of the Promoter’s knowledge, information and belief, correct as at the Opening Date.

7.8. If the Prize is a holiday or event:

   (a). The details of the Prize will outline the number of tickets provided, specifying the class of transport and carrier for the designated travel destination. Depending on the Prize type, Winners may have flexibility in choosing dates. Excluded dates for holiday prizes are outlined on the Website.

   (b). The Prize does not cover travel insurance, transfer costs to and from airports or stations, meals, beverages, spending money, taxes, personal expenses, or any items not explicitly mentioned as included on the website. Any additional costs incurred beyond those specified, which are incidental to fulfilling the prize, are the responsibility of the winner(s). A cash supplement may be part of the Prize if explicitly stated on the Website; however, this constitutes the extent of the Promoter’s liability.

   (c). You will be responsible for ensuring that you and any person travelling with you are available to travel and hold valid passports, any necessary visas and travel documents for the holiday in question on the travel dates specified. Dates once notified to the travel agent cannot be changed.

7.9The prize is not refundable, negotiable or transferable.

7.10 If the Prize is a vehicle:

   (a). The Promoter will, unless otherwise stated, ensure it comes with a valid MOT;

   (b). No insurance is included with the Prize and it is the Winner’s responsibility to ensure the vehicle is adequately insured prior to taking it on the public roads (if it is legal to do so);

   (c). The Promoter has no responsibility for the Prize once it has been delivered. The Winner is solely responsible for complying with all relevant laws and regulations relating to the vehicle, its operation and ensuring they operate it in a safe and responsible manner;

    (d). No vehicle/road tax is included;

  (e). The Winner is responsible for ensuring they have the necessary licences, qualification, knowledge and experience to operate the vehicle safely and legally.

8. GENERAL

8.1 Acceptance of the prize by the Winner will mean they are required to have their photo and video taken by the Promoter for promotional purposes (Public Relations and Marketing), both immediately after their win and in the future for use in accordance with rule 6.7, unless prohibited by law.

8.2 By entering a Competition, you agree to the use of your name, address, and/or photograph or other likeness, as well as your appearance at publicity events.

8.3 The Promoter reserves the right to cancel the Competition at any time either before or after tickets have been sold. If the Competition is cancelled, the Promoter will return any Entry Fees paid to each Entrant (either by bank card refund or by cheque and in one combined payment where several entries have been made by a competitor or store credit). Where the Entry Fee is returned, the Promoter shall have no further liability to the Entrant or to any other person.

8.4 Save for death or personal injury the Promoter will not be liable for any loss (including economic loss) suffered to or sustained by any person or property as a result of any act or omission of the Promoters, nor will their servants or their agents in developing, planning and Administrating the Competition, distributing the Prize to the Winner or following the distribution of the Prize. The Promoter accepts no liability for errors or omissions contained within the Prize details, description or specification or any other part of the Website. It is the responsibility of each Entrant (and in particular the Winner) to satisfy him/herself as to the accuracy of any such details and/or any content of this website.

8.5 The Promoter will not be liable for any loss suffered by an Entrant as a result of incomplete entries or failed computer communications or for any loss suffered as a result of use of the Website.

8.6 Carpi Competitions will not be accountable for any cancellations in flights, bookings or other arrangements  made via 3rd parties which are beyond their control. They will also not be bound to offer alternative solutions in replacement of prize trips for reasons beyond their control, this includes, weather, epidemics, pandemics, war, political unrest or any other forces beyond the operators control. It will be the responsibility of the third party booking agent to offer the best advice on steps to take.

8.7 The Promoter do not accept responsibility for entries which they do not receive due to failures in computer systems, other malfunctions, high Internet traffic, hardware failure, software failure, server faults or any other reason.

8.8 These competition rules shall not create or be construed as creating any form of contract, joint venture or other agreement between any Entrant and the Promoters.

8.9 An entry shall be declared void (without any refund being given) if the entrant engages in: 

  (a) any form of fraud (actual or apparent); 

  (b) fraudulent misrepresentation; 

  (c) fraudulent concealment; 

  (d) hacking or interference with the proper functioning of the website; or 

 (e) amending, or unauthorised use of, any of the code that constitutes the Website.

8.10 The Promoter reserves the right to amend these terms and conditions at any time.  Any changes will be immediately published on the competition home page.

8.11 The winner has sole responsibility for any duty/VAT as a result of taking delivery of a prize unless otherwise stated and also will be liable for any personal tax due on winnings.

9. Eligibility

9.1 The competition is only open to all people aged 18 years or over, except:

    (a) employees of the Promoter;

  (b) employees of agents or suppliers of the Promoter, who are professionally connected with the competition or its administration; or

   (c) members of the immediate families (1st grade) or households of (a) and (b) above.

9.2 By entering the competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the competition. If you fail to provide the Promoter with any such proof or other information that they may require within a reasonable time, you may be disqualified from the competition.

9.3 The Promoter will not accept competition entries that are:

   (a) automatically generated by computer; or

   (b) incomplete.

9.4 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.

9.5 No refunds of the entry fee will be given in any event, including:

   (a) if, following your entry into the competition, you subsequently find out that you are not eligible to enter the competition or claim the Prize;

   (b) if, following your entry into the competition the eligibility criteria for entering the competition or claiming the Prize changes and you are no longer eligible; or

    (c) if you are disqualified from the competition by the Promoter for any reason.

9.6 Entrants can enter the competition as many times as they wish until the maximum number of entries have been received. Entrants submitting free entries must submit each entry separately. Bulk entries, if received, will not be accepted and will only be counted as one single entry.

10. Anti Money Laundering Policy

10.1 On top of complying with all conditions as laid out by “The Gambling Act 2005” in relation to prize competitions, Carpi Competitions has put in place measures to prevent its systems from being used for the purposes of money laundering, terrorist financing or any other criminal activity.

10.2 Carpi Competitions is committed to preventing money laundering and combat the financing of terrorism in order to minimise and manage its reputational risk, legal risk and regulatory risk. It is also committed to its wider social responsibility in preventing crime by not allowing its systems to be used to commit crimes.

10.3 In order to adhere to Anti Money Laundering regulations and requirements, Carpi Competitions shall appoint a designated Money Laundering Reporting Officer (MLRO) whose responsibility it is to report possible acts of money laundering to the authorities. This role belongs to “Cristian Spac”.

10.4 Take reasonable steps to establish the identity of any person for whom it is proposed to provide its service.

10.5 Keep at all times a secure online list of all registered Players.

10.6 Retain identification and transactional documentation for each Player.

10.7 Provide initial and ongoing training to all relevant staff so that they are aware of their personal responsibilities and the procedures in respect of identifying Players, monitoring Player activity, record-keeping and reporting any unusual/suspicious transactions.

10.8 Ensure that this policy is reviewed and maintained regularly.

10.9 Examine, as much as is possible, the background and purpose of any complex or large transactions or groups of transactions which are likely, by their nature, to be related to money laundering or the funding of terrorism.

10.10 Not accept or open anonymous Accounts or Accounts in fictitious names such that the true beneficial owner is not known.

10.11 Not register a Player who is under eighteen (18) years of age.

10.12 Only register a single account in the name of a particular person.

10.13 Transfer payments of winnings or refunds back to the same route from where the funds originated, where possible.

10.14 Not accept cash from Players. Funds may be received from Players only by any of the approved methods.

10.15 Terminate a Player’s registration if it becomes aware that a person has provided false information when onboarding.

10.16 Report any suspicion or knowledge of money laundering of terrorism financing to the authorities.

10.17 Cooperate with all relevant administrative, enforcement and judicial authorities in their endeavour to prevent and detect criminal activity.

11. Limits of Liability

11.1 The Promoter makes no representations or warranties as to the quality/suitability of any of the goods or services offered as prize(s), or in connection with any of the Competitions promoted by the Promoter.

Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

11.2 The Promoter shall not be liable for:

  (a). any entries that are not received due to incorrect or inaccurate entry information, faulty or failed data transmissions or any other reason;

   (b). unauthorised access to, theft, destruction of or alterations to entries at any point;

  (c). technical malfunctions, errors, failures, omissions, interruptions, deletions, defects, delay in operation or communications line failure regardless of cause with regard to any equipment systems, networks, lines, satellites, servers, computers or providers used in any aspect of operation of a Competition;

  (d). inaccessibility or unavailability of network services, any wireless service, the internet and/ or a website (including but not limited to any online method for random selection of the Prize draw); and the Winner’s use of the Prize.
